Acquisition of citizenship of the Republic of Serbia by origin

Serbian citizenship, i.e. citizenship of the Republic of Serbia, is citizenship that could be obtained in the Republic of Serbia on several grounds. One of the grounds is based on the principle of ius sanguinis, that is, on the principle of origin.

If you are a foreign citizen whose parents have citizenship of the Republic of Serbia, and which they acquired before your birth, you acquire Serbian citizenship at birth.

Article 7 paragraph 1 of the Law on Citizenship states that citizenship of the Republic of Serbia is acquired by a child: whose parents are both citizens of the Republic of Serbia at the time of his birth.

However, if there is no information about this in the official records, the law allows you to submit a request to determine your citizenship. The request is submitted either directly to the competent police department in the country of origin or through the diplomatic – consular representation of Serbia abroad, and the Ministry of Internal Affairs of the Republic of Serbia decides on it in the form of a decision.

In the aforementioned case, renunciation of citizenship of another country and knowledge of the Serbian language are not required, and the procedure itself can be initiated without personal presence and arrival in Serbia, through an attorney at law.
